Are There Minimum Standards an Apartment Must Meet?
Absolutely: Yes, as stated in Section 535 of the German Civil Code. Realtor David Gramzow also confirms this. It is especially important that the apartment is fundamentally habitable. However, other aspects are also part of a minimum standard, according to Gramzow: “These include, among other things, a functioning heating system, electricity and water supply, a usable bathroom, and compliance with basic safety and health standards.”
Attorney Nicole Mutschke adds: “Smaller defects are usually not an obstacle to renting but may entitle tenants to a rent reduction depending on the individual case.” If the apartment is inspected beforehand and the defects are clearly visible, the rent reduction should be discussed with the property management or owner before moving in. In any case, the rent should not be reduced unilaterally. Defects should be reported to the property management. If they do not act promptly, a deadline must first be set. Only then should it be discussed with a lawyer whether the defects are so severe that an independent rent reduction is permissible.

Are Renovated Apartments More Popular Than Those Needing Renovation?
According to the realtor, renovated apartments are more in demand than those where tenants still need to carry out individual tasks. Whether an apartment is offered as renovated or in need of renovation largely depends on the type of construction work. Every renovation costs money and, depending on the apartment’s location, cannot easily be passed on to tenants. The rent control law is a major reason why management and owners do not renovate apartments to the extent necessary. As a result, according to the realtor, only the most necessary work is carried out in some cases.
Differences Between Sale and Rental in Minimum Standards
The realtor also observes that there are differences in the so-called minimum requirements of a property between sale and rental.
For properties that are for sale, marketing is generally easier. Simply because buyers do not have to deal with issues like electricity, bathroom, plumbing, or flooring immediately after signing the purchase contract. This also builds trust with potential buyers, making the purchase decision often easier.
“Apartments in need of renovation do find buyers, but they appeal to a smaller target group and often lead to price negotiations due to the expected renovation costs,” adds David Gramzow.
According to the realtor, renovated apartments generally sell better, but only if the property’s price is reasonable. “Even a high-quality renovated apartment must be priced according to the market to be sold within a reasonable timeframe.”
